Terms and Conditions Details

1. Interpretation

In these Conditions:

  • “Buyer” means the person who accepts a quotation of myhalalshoppe.com for the supply of Goods or who otherwise enters into a contract for the supply of Goods with myhalalshoppe.com.
  • “Conditions” mean the general terms and conditions set out in this document and any special terms and conditions agreed in writing between the Buyer and myhalalshoppe.com.
  • “Contract” means the contract for the purchase and sale of Goods, howsoever formed or concluded.
  • “Goods” means the items and products (including any instalment of the goods or any parts for them) which myhalalshoppe.com is to supply in accordance with a Contract.
  • “Writing” includes electronic mail, facsimile transmission, and any comparable means of communication.
  • “myhalalshoppe.com” is a business unit and division of ZOHL Industries Sdn Bhd, based in M2-15-02, Level 15, 8trium Tower 2, Jalan Cempaka SD 12/5, Bandar Sri Damansara, 52200, Kuala Lumpur, Malaysia.

Any reference to a statute shall be construed as a reference to that provision as amended, re-enacted, or extended at the relevant time. The headings in these Conditions are for convenience only and shall not affect their interpretation.

2. Basis of the Contract

The supply of Goods by myhalalshoppe.com to the Buyer under any Contract shall be subject to these Conditions, which shall govern the Contract to the exclusion of any other terms and conditions contained or referred to in any documentation submitted by the Buyer or implied by trade custom, practice, or course of dealing.

Information on myhalalshoppe.com’s website, including photographs, drawings, data about delivery, appearance, performance, dimensions, weight, operating materials, or costs, is for information purposes only and not binding. The Buyer acknowledges that it does not rely on such representations unless confirmed.

No variation to these Conditions shall be binding unless agreed in writing between authorized representatives of the Buyer and myhalalshoppe.com. Any errors in quotations, invoices, or other documents issued by myhalalshoppe.com may be corrected without liability.

Myhalalshoppe.com may provide electronic documents such as tax invoices, receipts, credit notes, or debit notes.

3. Orders and Specifications

Order acceptance and completion occur only upon myhalalshoppe.com issuing a confirmation of dispatch of the Goods. Myhalalshoppe.com may refuse or cancel any order without reason before issuing the confirmation. The Buyer may be required to provide contact and verification information prior to dispatch.

No Contract may be modified or cancelled by the Buyer except with written agreement from myhalalshoppe.com, and the Buyer shall indemnify myhalalshoppe.com against all losses, costs, damages, charges, and expenses incurred due to such modification or cancellation.

4. Price

The price of Goods and/or Services shall be as stated on myhalalshoppe.com’s website at the time of purchase. The price excludes packaging, delivery charges, and applicable taxes (e.g., sales and services tax or value-added tax), which the Buyer is liable to pay in addition to the price.

5. Terms of Payment

The Buyer may make payment using methods outlined on myhalalshoppe.com’s website, subject to the applicable terms and conditions.

5.1 Credit Card

Myhalalshoppe.com accepts Visa and MasterCard (Credit and Debit), 3D Secure enabled. All credit card information is protected by industry-leading encryption standards. Additional charges may apply for non-Malaysian issued cards due to foreign exchange.

5.2 Debit Cards

Myhalalshoppe.com accepts Malaysian Visa and MasterCard debit cards, subject to bank availability, with encryption protection.

5.3 Online Banking

The Buyer shall transfer payment (including taxes, fees, and shipping costs) to myhalalshoppe.com’s account in Ringgit Malaysia. Myhalalshoppe.com may refuse this payment option at its discretion. Accepted banks include AmBank, Bank Islam, CIMB Bank, Hong Leong, Maybank, Public Bank, and RHB.

5.4 Cash on Delivery

Currently unavailable. When available, it is offered in Klang Valley, Penang, and Johor Bahru for a RM5 fee per order, with delivery scheduled by myhalalshoppe.com and full payment required in cash upon delivery.

If the Buyer fails to make payment, myhalalshoppe.com may cancel the Contract, suspend deliveries, and/or charge 1% monthly interest on unpaid amounts until paid in full.

6. Delivery/Performance

Goods are delivered to the address specified by the Buyer. Myhalalshoppe.com may subcontract delivery obligations without notice. Delivery dates are approximate, and myhalalshoppe.com is not liable for delays. If delivery fails within a reasonable time, the Buyer may demand performance within at least 14 days. If myhalalshoppe.com fails to deliver, the Buyer may terminate the Contract for undelivered Goods and claim compensation for foreseeable losses, subject to limitations in Condition 12.4.

If the Buyer fails to take delivery (except for reasons beyond their control or myhalalshoppe.com’s fault), myhalalshoppe.com may sell the Goods and account for any excess or charge for any shortfall, or terminate the Contract and claim damages.

7. Risk and Property of the Goods

Risk of damage or loss passes to the Buyer upon delivery or when delivery is tendered but refused. Property in the Goods remains with myhalalshoppe.com until full payment is received in cleared funds. Until then, the Buyer holds the Goods as a fiduciary agent and Bailee, keeping them separate. The Buyer must notify myhalalshoppe.com of any issues affecting title and provide requested information. Myhalalshoppe.com may demand return of unpaid Goods and take legal action to recover them, with the Buyer liable for all related costs.

8. Warranties and Remedies

All warranties, conditions, or terms implied by statute or common law are excluded to the fullest extent permitted by law. Myhalalshoppe.com warrants that Goods correspond with their specification at delivery and will remedy non-conformities within 12 months from delivery. This warranty is subject to conditions, including no liability for improper use, defects from third-party actions, or unpaid Goods. Claims for defects must be notified within seven days of receipt or a reasonable time after discovery. Valid claims result in repair, replacement, or a price reduction (up to 15% of the affected Goods’ price). Non-conforming Goods become myhalalshoppe.com’s property upon replacement or refund.

9. Force Majeure

Myhalalshoppe.com is not liable for delays or failures due to causes beyond its reasonable control, including acts of God, war, government regulations, strikes, or power failures. Myhalalshoppe.com may suspend delivery or terminate the Contract without liability during such events.

10. Insolvency of Buyer

If the Buyer becomes insolvent, bankrupt, or ceases business, myhalalshoppe.com may cancel the Contract, suspend deliveries, and demand immediate payment for delivered but unpaid Goods.

11. Notices

Notices must be in writing, addressed to myhalalshoppe.com’s registered office or the Buyer’s address stipulated in the purchase offer.

12. Liability

Myhalalshoppe.com is liable for death or injury from its negligence but not for loss of profit, goodwill, production, or consequential losses. Liability for delayed performance is limited to ½% per week of delay, up to 5% of the delayed Goods’ value. Total liability shall not exceed the Contract price. Claims must be brought within 12 months of awareness or the end of the Warranty Period.

13. Termination

Myhalalshoppe.com may stop Goods in transit, suspend deliveries, or terminate the Contract if the Buyer breaches obligations, faces insolvency, or undergoes administration or receivership.

14. General

Incoterms definitions apply unless conflicting with these Conditions. No waiver of a breach constitutes a waiver of subsequent breaches. Invalid provisions do not affect others. Third parties have no rights under this Contract unless agreed in writing. The Contract is governed by Malaysian law, with disputes settled by arbitration at the Kuala Lumpur Regional Centre for Arbitration, except for intellectual property disputes, which may involve court proceedings. The UN Convention on Contracts for the International Sale of Goods does not apply.

Milk formula products are returnable unless for a “change of mind” request, provided they remain unopened. Return/refund or cancellations are not allowed for perishable goods, and Buyers should inspect contents upon receipt.
